Terms of Service

1. Acceptance of terms
By creating an account, connecting a mailbox, or otherwise using the MailPlate service (“Service”), you agree to these Terms of Service (“Terms”). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree to these Terms, you may not use the Service.
The Service is provided by MailPlate Inc. (“MailPlate,” “we,” “us,” or “our”).
2. The service
MailPlate is a unified inbox application that lets you connect Gmail and IMAP/SMTP mailboxes and read, search, send, reply to, label, and archive email through a single interface. The Service is currently in active development and may change over time, including the addition or removal of features.
3. Accounts and security
- You must provide accurate registration information and keep it up to date.
- You are responsible for maintaining the confidentiality of your sign-in credentials and any tokens issued to you.
- You must promptly notify us at hello@mailplate.com if you believe your account has been compromised.
- You are responsible for all activity that occurs under your account.
- The Service is not directed to children under 13 (or under 16 in the EEA). You must be old enough to form a binding contract in your jurisdiction.
4. Acceptable use
You agree not to:
- Use the Service to send spam, phishing, malware, or any other unsolicited or deceptive content.
- Use the Service in violation of any applicable law, including the CAN-SPAM Act in the United States, the EU ePrivacy Directive, anti-money-laundering laws, or export-control regulations.
- Attempt to gain unauthorized access to the Service, other accounts, or any connected mail provider.
- Reverse engineer, decompile, or attempt to extract source code from the Service, except to the extent that such restrictions are prohibited by applicable law.
- Interfere with the operation of the Service, including by overloading our infrastructure, evading rate limits, or scraping at a scale beyond what the user interface permits.
- Connect a mailbox you do not own or have explicit authorization to access.
- Use the Service to violate the terms of service of Gmail, your IMAP provider, or any other third-party service we integrate with.
5. Your content
You retain all rights to the email messages, drafts, attachments, and other content that you send, receive, or store through the Service (“Your Content”). You grant MailPlate a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and otherwise use Your Content solely to provide and improve the user-facing features of the Service. We do not use Your Content for advertising or to train generalized machine-learning models.

6. Third-party services
The Service depends on third parties, including Google (for Gmail and Google Sign-In), Supabase (managed Postgres / authentication), Vercel (hosting), and the IMAP/SMTP servers you connect. Your use of those services is subject to their own terms and privacy policies. MailPlate is not responsible for the availability, accuracy, or content of third-party services.
7. Fees and billing
The Service is currently free to use during the beta period. We may introduce paid plans in the future. If we do, we will give existing users at least 30 days’ notice and the opportunity to choose a plan, downgrade, or export their data before any fees take effect.
8. Termination
You may stop using the Service and delete your account at any time by emailing hello@mailplate.com. When you delete your account we delete your account record, encrypted mailbox credentials, and cached mailbox data within 30 days, except where retention is required by law.
We may suspend or terminate your access to the Service, in whole or in part, with or without notice, if we reasonably believe you have violated these Terms, if required by law, or if your account creates a security or operational risk to the Service.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
MailPlate does not warrant that the Service will be uninterrupted, secure, error-free, or that any defects will be corrected. You are responsible for keeping independent backups of email data that matters to you.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MAILPLATE OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE.
MailPlate’s aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amounts you paid us for the Service in the twelve months preceding the event giving rise to the liability or (b) USD 100.
11. Indemnification
You agree to indemnify and hold MailPlate harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from (a) your use of the Service in violation of these Terms or applicable law, (b) Your Content, or (c) your violation of any third party’s rights, including the terms of any mail provider you connect.
12. Governing law and disputes
These Terms are governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict-of-laws principles. Any dispute arising under or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction in those courts. Nothing in this section limits any rights you may have under mandatory consumer-protection laws in your jurisdiction.
13. Changes to these terms
We may update these Terms from time to time. Material changes will be announced via email or an in-app notice at least 30 days before they take effect. By continuing to use the Service after the effective date, you accept the revised Terms. The “Last updated” date at the top reflects the most recent revision.
14. Miscellaneous
- These Terms, together with the Privacy Policy, constitute the entire agreement between you and MailPlate concerning the Service.
- If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
- MailPlate’s failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
- You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
